Landmark AI Accountability Act Passes Congress, Reshaping Industry Oversight

After months of negotiation, Congress has passed the AI Accountability Act, the most comprehensive federal framework for regulating artificial intelligence in the United States. The legislation establishes testing, transparency, and disclosure requirements for “high-impact” AI systems used in hiring, lending, healthcare, and critical infrastructure.

The law requires developers to conduct independent risk assessments before deploying covered systems, maintain documentation of training data sources, and provide clear notice to individuals when AI is used to make consequential decisions about them. It also creates a new office within the Commerce Department to certify independent auditors.

Industry response has been mixed. Major technology companies largely supported the framework, having already adopted many of its provisions voluntarily, while smaller startups expressed concern about compliance costs. Civil society groups praised the protections for consumers but called for stronger enforcement mechanisms.

The rules take effect on a phased timeline over the next 18 months, giving organizations time to build compliance programs. Legal experts advise companies to begin auditing their AI deployments now, documenting decision-making processes, and establishing internal governance committees to meet the new standards.
